PRIVACY POLICY
FOR MOOVMENT® PRO USERS AND WEBSITE VISITORS
1. THE SCOPE OF THE PERSONAL DATA POLICY
1.1. The following describes how Qinematic AB, org. no. 556890-1903, with visiting address at Lahällsvägen 48, 183 30 Täby, Stockholm, Sweden ("Qinematic", "us" or "we"), processes personal data in relation to you as a user of Moovment Pro, and you who visit our websites www.moovment.pro and www.qinematic.com, (the "Website"). It also describes how Moovment Coach International AB, org. no. 559027-9922, a service company 100% owned by Qinematic AB and with the same address (“Moovment Coach”), manages your personal data as a Controller.
1.2. We believe personal privacy is important and we take your privacy very seriously. It is therefore important for us to protect your personal data and to ensure that processing takes place in a correct and legal manner.
1.3. In this personal data policy, we explain what types of personal data we may process and for what purpose we process them. We also report on our processing of personal data and what choices and what rights you have in relation to it. We ask you to read our personal data policy carefully and ensure you understand its contents.
1.4. Please note that this personal data policy only concerns the processing of personal data for which Qinematic is responsible as a Processor, and Moovment Coach is responsible as a Controller. You are welcome to contact us directly (see section 11) with questions or comments, or if you want to exercise any of the rights you have in relation to our handling of your personal data.
1.5. For you who are a user of Moovment Pro, your personal data may be processed by a health service provider other than Moovment Coach, and they may offer you consultation services through Moovment Pro. For the health service provider’s processing of personal data that takes place to offer you consultation services, that health provider is responsible for personal data. For more information about the health service provider's processing of your personal data, we therefore refer you to the health service provider's own personal data policy.
1.6. If you have been referred by an organisation, such as your insurance company, to a health service provider who offers care through Moovment Pro, the organisation is responsible for your personal data and for the processing of your personal data that takes place in connection with the insurance case. For more information about the insurance company's processing of your personal data, we therefore refer you to your insurance company's personal data policy.
2. PERSONAL DATA PROCESSING - USERS
2.1. Personal information refers to information that can be attributed to you. We may handle the following personal information that can be attributed to you as a user of the Moovment Pro web application:
a. contact details (name, e-mail address, address and telephone number);
b. information about your health;
c. recording of your image;
d. cookies;
e. IP address; and
f. token for authentication.
2.2. Note that the provision of your personal information is a prerequisite for entering into an agreement with us for the Moovment Pro service.
3. PURPOSES OF PROCESSING - USERS
3.1. We process your contact information (item 2.1 (a)) in order to be able to handle our communication with you as a user of Moovment Pro.
3.2. We process your contact information (item 2.1 (a)) and information about your health (item 2.1 (b) and recording of your image (item 2.1 (c)) in order to
a. Analyse and visualise the results for use by yourself and a health service provider
b. To conduct our own research and development so that we can improve the service.
3.3. We process cookies and your IP address (items 2.1 (d) - 2.1 (e)) to develop Moovment Pro and improve the user experience.
3.4. We process your token for authentication (item 2.1 (f)) to ensure that only authorized users can log in to the Moovment Pro web application.
3.5. Since Moovment Pro is a health service, all personal information listed in section 2.1 can be traced to your health. This means that this personal data is considered sensitive and is therefore processed only after your prior consent.
3.6. You have the right to withdraw your consent to our processing of your personal data at any time. Note, however, that your consent to the purposes in sections 3.1 and 3.4 is a prerequisite for us to be able to offer you the Moovment Pro service. Personal data that is anonymised may be used on an ongoing basis for research and development.
4. PERSONAL DATA PROCESSING - WEBSITE VISITORS
4.1. We may handle the following personal information that can be attributed to you as a visitor to the Website:
a. cookies;
b. name;
c. companies;
d. email address;
e. telephone number; and
f. IP-address.
4.2. Note that the information in points 4.1 (b) - 4.1 (f) above is only processed in relation to such visitors to the Website who register on the Website for more information.
5. PURPOSES OF THE PROCESSING - WEBSITE VISITORS
5.1. We process information about cookies (section 4.1 (a)) in order to develop and improve the Website and the user experience.
5.2. We process the information in points 4.1 (b) - 4.1 (f) in order to be able to develop our services and the Website, and to market our services to you.
5.3. We process your personal data listed in section 4.1 after your prior consent.
5.4. You have the right to withdraw your consent to our processing of your personal data at any time. You can revoke your consent only in relation to a certain part of our processing, for example the processing that takes place for marketing.
6. STORAGE OF PERSONAL DATA
6.1. We store your personal data for as long as is necessary to fulfill the purpose of the processing.
6.2. If you cease to be a user of Moovment Pro, we will delete the personal data in points 2.1 (a) - 2.1 (f) within three months of you ceasing to be a user. However, we may anonymise your person information about your health (item 2.1 (b)) and your recorded image (item 2.1 (c)) to use for ongoing research and development.
6.3. Cookies (items 2.1 (d) and 4.1 (a)) are deleted no later than one year after the cookie is created.
6.4. We retain information about visitors who have registered for more information (items 4.1 (b) - 4.1 (f)) for a maximum of two years after registration.
6.5. If you revoke your consent to certain processing, or your personal data is no longer necessary to fulfill the purpose of the processing, or if the processing is no longer permitted for other reasons, the data will be anonymised or deleted.
7. COOKIES
7.1. The website uses cookies. Cookies are small text files that are stored on our visitors' computer and can be used to follow a visitor's actions on the Website.
7.2. We use so-called tracking cookies, which aim to share information between websites to collect information and give you customized information and marketing. Section 8.3 shows who we share cookies with.
7.3. We use cookies only if you have given your consent to them. If you do not accept the use of cookies, you can turn off cookies in your browser's security settings. You can also set the browser so that you get a question every time the Website tries to place a cookie on your computer. Previously stored cookies can also be deleted through the browser. See the browser's help pages for more information. Furthermore, you can delete cookies manually from your hard drive at any time.
7.4. Please note that if you choose not to accept cookies, functionality may be limited on certain websites.
8. THIRD PARTIES
8.1. We may disclose your personal data to our personal data assistants. For example, companies that work with IT and cloud services or payment administration services. We may also share your information with the health service provider that offers you services through Moovment Pro, or to the organisation that formally referred you to us, such as an insurance company.
8.2. We use Microsoft® Azure for our infrastructure, making them a sub-processor of your data. You can read about their gold-standard privacy and security on their Trust Center website.
8.3. In the event of a suspected breach of law or of our general terms and conditions, we may disclose your personal information to law enforcement agencies, as well as to our legal advisors.
8.4. Provided that you have given your consent to the use of cookies, we may also share information about cookies with Facebook and Google for behaviour analysis and targeted marketing.
9. YOUR RIGHTS
9.1. You have the right to receive confirmation of whether we process personal data concerning you, and in that case to have access to this personal data, as well as information about the personal data and our handling of them.
9.2. You have the right to have incorrect personal data concerning you corrected by us without undue delay. You also have the right to supplement incomplete personal data in certain cases, considering the purpose of the processing.
9.3. You have the right to withdraw your consent to our processing of your personal data at any time. Note, however, that this affects the ability for us to offer you the Moovment Pro service.
9.4. You have the right to object to our processing of your personal data that takes place for direct marketing. If you make such an objection, we will no longer process your personal data for that purpose.
9.5. You have the right to have your personal data deleted by us under certain circumstances, e.g. if the personal data are no longer necessary to fulfill the purposes for which they were collected, or if the personal data has been processed illegally.
9.6. You have the right to demand that we limit the processing of your personal data in certain cases. For example, if you dispute the accuracy of the personal data, you can demand that we limit the processing of the data during the time it takes us to check whether the data is correct.
9.7. You have the right to obtain the personal data that you have provided to us and that concerns you in an electronic format that is widely used. You have the right to transfer such data to another personal data controller (data portability).
9.8. If you have views on our processing of your personal data, you are welcome to contact us. You also have the right to submit a complaint about the processing of your personal data to the Data Inspectorate.
10. ADDITIONS & CHANGES
We may make updates or changes to this Privacy Policy. The Privacy Policy will be available on our website www.qinematic.com/legal. If we make any significant changes, we may notify you in an appropriate manner, for example by e-mail. If this happens, we ask you to carefully read the updated personal data policy.
